Buyer: the person who provides name, surname and contact details at the time of booking and purchases the accommodation service.
This agreement sets out the rights and obligations of the parties regarding the accommodation service purchased by the buyer from Via Otel through distance communication tools such as the website, WhatsApp, telephone or e-mail. It is subject to the Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
The essential characteristics of the service — room type, check-in and check-out dates, number of guests, breakfast — and the total price are notified to the buyer in writing (WhatsApp or e-mail) in the booking confirmation. The stated price includes breakfast, VAT and accommodation tax; additional services such as an extra bed, transfer or special occasion setting are priced separately and stated in the confirmation.
Check-in is from 14:00 and check-out is by 12:00 at the latest. Early check-in and late check-out are subject to availability and may incur an additional charge. All guests are legally required to present an identity document.
No deposit is taken. Payment is made at check-in, in cash or by credit card. Once online payment is activated, card details are not stored by the seller; the transaction is processed through the infrastructure of a licensed payment institution.
Cancellation and change requests must be sent in writing (WhatsApp or e-mail). For cancellations received at least 7 days before the check-in date, any amount paid is refunded in full. For later cancellations, and if the guest does not arrive without cancelling (no-show), the first night is charged; no fee is charged for the remaining nights. Date change requests are accommodated free of charge, subject to availability.
Pursuant to Article 15, paragraph 1, subparagraph (g) of the Distance Contracts Regulation, the consumer has no right of withdrawal in contracts for accommodation services to be provided on a specific date or within a specific period. Therefore the 14-day right of withdrawal does not apply to bookings made for specific check-in and check-out dates; cancellation is governed solely by Article 6. The buyer acknowledges having been informed of this before booking.
In unforeseeable events beyond the parties' control, such as natural disasters, epidemics or decisions of public authorities, neither party is liable for failure to perform its obligations. In such cases the buyer is offered a change of dates or a refund of the amount paid.
Disputes arising from this agreement fall within the jurisdiction of the Consumer Arbitration Committees of the buyer's place of residence or the place where the service is provided, up to the monetary limits announced annually by the Ministry of Trade, and of the Consumer Courts above those limits.
The buyer declares that they have read and accepted this agreement and the pre-contractual information before submitting the booking request.
